Representatives from the Agency for Health Care Administration (AHCA) will provide timely, first-hand insights on the most pressing issues affecting providers today. This session is your opportunity to understand what’s driving policy decisions, anticipate changes on the horizon, and prepare your organization for what lies ahead.
Kimberly R. Smoak, MSH, QIDP, is Deputy Secretary of the Division of Health Quality Assurance at the Agency for Health Care Administration (AHCA) and serves as the State Survey Agency Director for Florida. Since joining AHCA in 1995, she has overseen licensing and regulatory functions for 40 provider types, including hospitals, nursing homes, assisted living facilities, and home health agencies. She earned a Master of Science in Health with an emphasis in Aging Studies and is a Qualified Intellectual Disability Professional (QIDP). In 2009 and 2017, CMS presented her with Survey & Certification Achievement Awards for her contributions to survey and certification.
Susan Lowery, RN, BSN, is a seasoned registered nurse with over 30 years of clinical and administrative experience, including more than two decades in home health care. Her career began in direct patient care as a field nurse and evolved into leadership roles in home health management. For over 12 years, she has served within the Florida Agency for Health Care Administration (AHCA), where she has held a range of positions including Registered Nurse Specialist Surveyor, Registered Nurse Consultant in the Complaint Unit, Informal Dispute Panel Member, and OASIS Education Coordinator for the state. She currently serves as a Government Analyst in the Office of the Chief of Field Operations, contributing to statewide healthcare oversight and policy implementation. Her work reflects a deep commitment to quality assurance, regulatory compliance, and the advancement of public health standards.
Kimberly McIntyre, RN, is a registered nurse with over 20 years of clinical and managerial experience. She is currently working in the role of Senior Management Analyst Supervisor and oversees a team of nurses specializing in home health with particular focus on aides for medically fragile children. She also serves as the Home Health and Hospice Independent Dispute Resolution Coordinator. Her career path has included hands on care in the surgical setting, home health, and hospice as well as provided guidance to students while working as a clinical educator. Kimberly states that her greatest and most cherished role is that of advocate for those who cannot speak for themselves.

Melanie Stover, OT, MBA, MS/ISM, is founder and owner of Home Care Sales, LLC, where she merges her clinical background as an occupational therapist with nearly three decades of post-acute care expertise. Since 2001, she has helped agencies build sustainable growth strategies, high-performing sales teams, and strong referral streams. Her innovations include the Total Patient Care Delivery Model™, the High-Performance Sales Academy™, RoadMap to Referrals™, and Agency Ambassador™ programs, along with the RepMastery coaching framework. These resources have become industry standards, enabling agencies to deliver seamless transitions across home health, palliative, hospice, and in-home care.

Employment Law Update for Private Care Home Care Agencies
Colby Ellis & Joshua Vaughn, Littler
Staying compliant with employment and labor requirements is critical for every home care agency. This workshop will help participants understand compensable time rules, general travel time requirements, and best practices for managing live-in and extended shifts. Attendees will also explore consumer-directed care models such as nurse registries and virtual marketplaces, with guidance on distinguishing between independent contractors and employees. Finally, the session will clarify agency responsibilities and client obligations under service agreements, ensuring participants leave with a clear roadmap for compliance and risk management.
Colby J. Ellis, Esq., is an Associate at Littler, representing employers across multiple industries in employment and labor law matters. He has appeared before federal and state courts as well as agencies such as the Equal Employment Opportunity Commission (EEOC), National Labor Relations Board (NLRB), Occupational Safety and Health Administration (OSHA), the U.S. Department of Labor (DOL), and the Florida Commission on Human Relations.
Prior to joining Littler in 2023, Colby worked at a boutique management-side labor and employment law firm in Tampa. He earned his J.D. from the University of Florida, where he served as Student Bar Association president and executive articles editor of the Florida Journal of Law and Public Policy. He also externed for U.S. District Judge Mark E. Walker of the Northern District of Florida.
Joshua C. Vaughn, Esq., is a Shareholder at Littler and an employment defense attorney based in Pittsburgh. He represents employers in collective, class, and hybrid wage and hour actions under the Fair Labor Standards Act (FLSA) and state laws. He has defended clients in health care, financial services, retail, and technology, often defeating certification in large-scale cases.
Josh also leads Littler’s Home Care Toolkit, counseling agencies on employment issues unique to the industry. He has represented agencies in litigation, Department of Labor (DOL) investigations, and compliance audits. He regularly trains employers, writes on employment law, and has taught Technology and Employment Law as an adjunct professor at the University of Pittsburgh School of Law.

Attendees will learn how to benchmark their performance against industry standards, evaluate capital options such as credit lines, SBA loans, reinvested profits, and private investment, and understand what lenders look for when financing agencies. The session will also cover how to assess loan terms, recognize predatory lending practices, and manage debt responsibly, ensuring agencies can scale with confidence and long-term financial stability.
Ethan Schwarzbach is the Co-Founder and Chief Executive Officer of Flychain, which he founded to help small- and medium-sized health care providers overcome cash flow challenges caused by delayed insurance payments. Inspired by his father’s struggles running a dental practice, Ethan built Flychain to democratize access to enterprise-level financial tools.
He has 15 years of experience at the intersection of finance and technology, including roles in small business lending, banking, accounting, and payments. He previously co-founded a company that was acquired and worked in fixed income at the Royal Bank of Scotland. Ethan earned a Bachelor of Arts in Public Policy Analysis and History from Duke University.
